The Online Store respects consumer rights. A consumer may not waive any rights granted under the Consumer Rights Act. Any provisions less favorable to the consumer than those of the Consumer Rights Act are void and replaced by the Act's provisions. These Terms and Conditions do not aim to exclude or limit any mandatory consumer rights; any doubts shall be interpreted in favor of the consumer. In case of any conflict between these Terms and Conditions and mandatory legal provisions, the law shall prevail.

1. General Provisions

  1. The Online Store available at www.shinepoint.eu is operated by ShinePoint, registered in the Dutch Chamber of Commerce under KVK 96979410, with its registered office at Kollenbergweg 40, 1101AR Amsterdam, Netherlands; email: contact@shinepoint.eu; phone: (+31) 620-722-895.
  2. These Terms and Conditions apply to both consumers and entrepreneurs using the Online Store, unless a provision specifies otherwise.
  3. The data controller of personal data processed in connection with these Terms and Conditions is ShinePoint. Personal data are processed according to the Privacy Policy published on the Online Store, which details the purposes, legal bases, scope of processing, users’ rights, and cookie/analytics usage. Use of the Online Store and provision of personal data are voluntary, except as required to conclude the contract or by law.
  4. Definitions:
    • Business Day – Monday to Friday excluding public holidays;
    • Registration Form – electronic form to create an Account;
    • Order Form – interactive form enabling placement of an Order, including cart and delivery/payment choices;
    • Client – (1) a natural person with legal capacity; (2) a legal person; or (3) an organizational unit without legal personality but with legal capacity, who concludes or intends to conclude a Sales Contract;
    • Civil Code – the Dutch Civil Code (Burgerlijk Wetboek);
    • Account – electronic service identified by login and password, storing user details and order history;
    • Newsletter – email distribution service for product news and promotions;
    • Product – a movable item offered for sale;
    • Terms and Conditions – these Terms and Conditions;
    • Online Store – www.shinepoint.eu;
    • Seller – ShinePoint;
    • Sales Contract – contract for sale of a Product concluded via the Online Store;
    • Electronic Service – service provided electronically by ShinePoint;
    • Service Recipient – entity using an Electronic Service;
    • Consumer Rights Act – Dutch implementation of EU Consumer Rights Directive;
    • Order – statement of intent to conclude a Sales Contract via the Order Form.

2. Electronic Services in the Online Store

  1. Available Electronic Services: Account, Order Form, Newsletter.
    1. Account – free, indefinite. To register: fill in the Registration Form (name/company, email, password; entrepreneurs also provide VAT number) and click “Submit.” Users may delete their Account at any time by emailing contact@shinepoint.eu.
    2. Order Form – free, one-time; ends upon Order placement. To use: add items to cart, fill in the Order Form (contact, delivery, payment details), and click “Confirm Purchase.”
    3. Newsletter – free, indefinite. Subscribe by entering your email in the Newsletter tab or via Account registration. Unsubscribe anytime via email to contact@shinepoint.eu.
  2. Technical Requirements: Internet-enabled device, email access, modern browser with cookies and JavaScript enabled.
  3. Users must act lawfully and truthfully, respecting intellectual property and third-party rights. Unlawful content is prohibited.
  4. Complaints Procedure for Electronic Services: Submit to contact@shinepoint.eu (email) or by post to the registered office. Include description, desired remedy, and contact details. ShinePoint responds within 14 calendar days.

3. Conditions for Concluding the Sales Contract

  1. A Sales Contract is concluded by placing an Order via the Order Form as per section 2.1.2 above.
  2. Prices shown include VAT and any other taxes. Total price and delivery costs are displayed before Order confirmation.
  3. Upon Order placement, ShinePoint immediately confirms receipt and acceptance by email. The contract is formed when the customer receives this email.
  4. The contract text is made available via these Terms and Conditions online and the confirmation email. It is also stored in ShinePoint’s IT system.

4. Methods and Deadlines of Payment for the Product

  1. Available payment methods:
    • Cash on personal collection;
    • Bank transfer to ShinePoint’s account;
    • Electronic payments and card payments via iDeal/Stripe
  2. Transfer, electronic, and card payments: due within 7 calendar days of contract conclusion. Cash payments due upon delivery or collection.

5. Cost, Methods and Deadlines of Delivery and Collection of the Product

  1. Delivery is available within the Netherlands.
  2. Delivery is paid unless stated otherwise. Costs are shown on the website and at checkout.
  3. Personal collection is free.
  4. Delivery/collection options:
    • Courier (prepaid);
    • Personal collection at ShinePoint office during business hours.
  5. Delivery time: up to 7 Business Days from payment receipt (or contract date for cash on delivery). For mixed lead times, the longest applies (max 7 Business Days).
  6. For personal collection, products are ready within 2 Business Days from payment receipt (or contract date).

6. Product Complaints

  1. ShinePoint’s liability for defective Products is governed by mandatory law (Civil Code articles on warranty).
  2. Products must be delivered defect-free. Detailed warranty rights are on the website.
  3. For used or non-standard Products, liability is limited as described in the product description.
  4. Complaints may be submitted via email to contact@shinepoint.eu or by post to the registered office. Include defect details, desired remedy, and contact information. ShinePoint responds within 14 calendar days.
  5. Consumers send defective Products at ShinePoint’s expense; entrepreneurs bear return costs.

7. Out-of-Court Complaint and Claims Procedures

  1. Information on out-of-court dispute resolution is available on the Dutch Consumer Authority website and via the European ODR platform at ec.europa.eu/consumers/odr.
  2. Consumers may also contact local consumer rights organizations and the ADR contact point of the Dutch Authority for Consumers & Markets.

8. Right of Withdrawal

  1. Consumers have 14 calendar days to withdraw without reason or costs (except return shipping and additional delivery costs if they chose a more expensive method).
  2. Withdrawal period begins upon product receipt (or last item for multiple deliveries).
  3. To withdraw, send a statement by email to contact@shinepoint.eu or by post.
  4. ShinePoint refunds all payments within 14 days of withdrawal receipt, using the original payment method.
  5. Consumers return the Product within 14 days; ShinePoint may wait for its receipt before refunding.
  6. Consumers bear diminished value costs only if they used the Product beyond inspecting its nature and features.
  7. Exclusions to the right of withdrawal include sealed hygiene products, custom items, perishable goods, digital content after download, and others as per Consumer Rights Act.

9. Provisions Concerning Entrepreneurs

  1. Applies only to non-consumer Clients.
  2. ShinePoint may withdraw from contracts with entrepreneurs within 14 days without liability.
  3. Entrepreneurs may be required to prepay.
  4. Risk passes to the entrepreneur upon handover to the carrier.
  5. Warranty for entrepreneurs is excluded by Dutch law.
  6. Disputes are subject to the competent court in Amsterdam.
  7. ShinePoint may terminate electronic services to entrepreneurs immediately.
  8. Liability to entrepreneurs is limited to the contract value, max €1,000, excluding lost profits.

10. Final Provisions

  1. Contracts are concluded in English.
  2. ShinePoint may amend these Terms and Conditions for valid reasons (legal changes, payment/delivery updates). Continuous service agreements remain subject to amended terms if properly notified; one-off sales are not affected.
  3. Matters not covered herein are governed by Dutch law, including the Civil Code and Electronic Commerce Act.

11. Model Withdrawal Form

12. Promotions and Contests Regulations

  1. ShinePoint promotions and contests (“Events”) are open to participants meeting the eligibility criteria specified in each Event’s rules.
  2. Detailed rules, including entry period, eligibility, method of entry, prize description, selection of winners, and notification procedures, are published at the time of the Event on the Online Store.
  3. Employees of ShinePoint and their immediate family members are not eligible to participate.
  4. Winners will be selected by random draw or judging panel as specified, and notified via email within 7 days of the Event’s end.
  5. Prizes will be delivered or made available within 30 days of winner confirmation. Taxes or fees, if any, are the responsibility of the winner.
  6. By participating, entrants consent to the use of their name and likeness for promotional purposes without additional compensation.
  7. Personal data collected will be processed according to the Privacy Policy.
  8. ShinePoint reserves the right to cancel or modify Events if required by law or unforeseen circumstances.
  9. Any disputes arising from Events will be governed by Dutch law and settled by the competent court in Amsterdam.
